Is still ok to use CCP XCS despite Kryptronic statements?

We bought the CCP XCS upgrade version and paid for installation (but haven't yet got it operating- we are still running CCP6) shortly before the statements from Kryptronic that:

"GreenBarnWeb is no longer an authorized distributor of Kryptronic software, and their ClickCartPro XCS software is nothing more than a PIRATED VERSION of Kryptronic's ClickCartPro 6 with modifications made by GreenBarnWeb. GreenBarnWeb has been notified to cease and desist sales of ClickCartPro XCS, as it's being sold without Kryptronic's consent in an illegal manner".

We don't know whether to carry on with getting our CCP XCS upgrade working or to try to get a refund from GreenBarnWeb. Any thoughts anyone?

The simple answer is yes.

We have a valid contract that gives us exclusive rights to produce a European version of the software with exclusive software features and payment gateways. We also hold the European trademark for the software. Kryprtronic does not have the right under the contract to terminate the contract without our agreement.

With hindsight the main problem was that Kryptronic was making losses during 2009 and I know that they did not make payments to Zipskins and Dave Martin (Kryptronic Support Man) for most of 2009. Dave Martin left because Kryptronic stopped paying him. This caused Kryptronic to try and take over the European market as the sales were 4 times more than in the US.
